Terms of Service – LUNA AI Art Generator

1. Acceptance of Terms

Welcome to LUNA AI Art Generator, operated by Rocket Digital Limited ("Company", "we", "us", or "our"). By downloading, installing, or using the LUNA mobile application or visiting our website at lunaaiartapp.com, you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, please do not use LUNA. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

LUNA is an AI art generator app that allows users to create images from text prompts using various AI image generation models. The Service includes access to 20+ AI models, 100+ art styles, portrait generation, photo-to-art transformation, and high-resolution export features. LUNA is available on iOS and Android platforms.

3. Eligibility

You must be at least 13 years of age (or 16 in certain jurisdictions) to use LUNA. By using the Service, you represent that you meet this age requirement. Users under 18 must have parental consent to use the Service and make purchases.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must provide accurate and complete information when creating an account
• You must notify us immediately of any unauthorized use of your account at hello@rocketdigital.ai
• We reserve the right to terminate accounts that violate these Terms

5. Subscriptions and Payments

5.1 Free Tier

LUNA offers a free tier with a limited number of AI art generations per day. Free-tier users may see advertisements served by Google AdMob.

5.2 Premium Subscriptions

Premium subscriptions unlock additional generations per day, higher resolution exports, access to exclusive AI models, and an ad-free experience. Subscription pricing is displayed within the app.

5.3 Billing and Cancellation

• Subscriptions are billed in advance on a monthly or annual basis through the App Store (iOS) or Google Play (Android)
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• You can manage and cancel subscriptions through your App Store or Google Play account settings
• Refunds are subject to the refund policies of Apple App Store or Google Play

6. Acceptable Use Policy

You agree to use LUNA only for lawful purposes and in accordance with these Terms. You must NOT use LUNA to:

• Generate content that is sexually explicit, obscene, or pornographic
• Create images depicting real individuals without their consent in defamatory, harassing, or harmful contexts
• Generate content that promotes violence, hatred, or discrimination
• Create deepfakes or misleading media intended to deceive or harm others
• Infringe upon intellectual property rights of third parties
• Attempt to bypass, circumvent, or disable any security features of the Service
• Use automated tools, bots, or scripts to access the Service beyond normal use
• Resell or redistribute access to the Service without authorization
• Generate content that violates any applicable laws or regulations
• Attempt to reverse-engineer or extract AI models from the Service

We reserve the right to remove any content and terminate any account that violates these guidelines without prior notice.

7. Intellectual Property and Content Ownership

7.1 Your Content

You retain ownership of the text prompts and photos you upload to LUNA. By using the Service, you grant us a limited license to process your inputs solely for the purpose of generating AI art as requested.

7.2 AI-Generated Images

AI-generated images created through LUNA may be used for personal, creative, and non-commercial purposes. The status of AI-generated content under copyright law varies by jurisdiction. We make no warranties regarding the ownership or copyrightability of AI-generated images.

For commercial use of AI-generated images, you assume full responsibility for ensuring compliance with applicable laws and the terms of the underlying AI model providers.

7.3 Our Intellectual Property

The LUNA app, website, brand, logo, and all underlying technology are the exclusive property of Rocket Digital Limited. You may not copy, modify, distribute, or create derivative works based on our proprietary materials without written permission.

8. AI Model Providers

LUNA provides access to AI image generation models from third-party providers including OpenAI, Google, Flux/Black Forest Labs, Ideogram, Recraft, and others. The use of these models is subject to the respective providers' terms of service. We make no warranties regarding the availability, accuracy, or appropriateness of outputs from these models.

9. Disclaimer of Warranties

LUNA IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROCKET DIGITAL LIMITED SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Rocket Digital Limited and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your access to LUNA at any time, with or without notice, for violating these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

14. Changes to Terms

We may revise these Terms at any time. We will provide notice of material changes by updating the effective date and, where appropriate, providing in-app notifications. Your continued use of LUNA after changes are posted constitutes your acceptance of the revised Terms.
